1. Applying the conditions of Use
By accessing or using any part of FindPolishBuilder.com you agree to be bound by the following conditions of use. If you do not wish to be bound by these conditions you must not access or use FindPolishBuilder.com
We may, at any time and without notice to you, make changes to these terms and conditions. 2. Representation Disclaimer
a) FindPolishBuilder.com advertise and promote businesses through its website in the category/categories selected by its members.
b) In respect of the advertisements provided by our Members we reserve the right to reject remove and/or amend any advertisement or part thereof which in our opinion is obscene, defamatory, infringes the copyright or other rights of any third party, or which is otherwise illegal.
c) FindPolishBuilder.com does not guarantee or underwrite the suitability, financial status or value of any customer contacting members as a result of their entry on the website. FindPolishBuilder.com is not able to accept any responsibility or liability for any loss suffered by members or any customer of members or any other person arising out of their entry on the website, howsoever caused. Members will indemnify FindPolishBuilder.com for any loss we suffer as a result of any action brought against us as a result of a members entry, the material contained therein or any service or product supplied by members.
d) You agree to indemnify and hold us and where applicable our parents, subsidiaries, affiliates, directors, agents and employees against any claim or demand, including reasonable legal costs made by any third party due to or arising out of any breach of this agreement or of your breaking the law or violating the rights of a third party and further agree to indemnify us in respect of ay action brought against us as a result of a Members entry and any other factors relating thereto.
e) FindPolishBuilder.com may as it sees fit, send a customer, a Customer Satisfaction Survey. The customer will be able to provide information relating to a Members performance in a number of different areas and whilst this information may be made available for potential users of the website, we accept no liability for the content of the same.
3. Database, trademarks and copyright
Except where otherwise stated or agreed FindPolishBuilder.com owns all intellectual property rights in and to the FindPolishBuilder.com website (including the database, design, text, graphics and layout) and any software used. You agree not to use or copy the same or any part thereof without the consent of FindPolishBuilder.com. In particular, you acknowledge that FindPolishBuilder.com owns all rights, including trademark, servicemark and allied rights in and to the names and marks FindPolishBuilder.com and any constituent parts.
4. Conditions for our Members
a) In providing information about their company, business, owners and staff, the Member confirms that this information is up to date, accurate, truthful and not misleading in any way.
b) It is agreed between FindPolishBuilder.com and its members that the name is recognised and respected by the public. To ensure that this remains the case, Members agree that any Member who is shown to be unreliable, dishonest or lacks the appropriate qualifications will be removed from the website
c) Neither we or our members shall have any liability under or be deemed to be in breach of these terms and conditions which results from circumstances beyond the reasonable control of the parties.
5. Rights and Reservations
a) The right to expand, change or revise the FindPolishBuilder.com service in any way upon giving reasonable notice of any such change to our members.
b)These terms and conditions shall be governed by and construed in accordance with the Laws of England and Wales and the parties accept non-exclusive jurisdiction of the English courts over any claim or matter arising under or in connection with these terms and conditions.
c) Any part of these terms and conditions which may be deemed to be outside the law or unenforceable by reason of legality, such term or condition shall be severable and the remainder of the terms and conditions will continue to be binding upon the Members
d) At any time we may decide to limit your activity(s), suspend or terminate your membership of FindPolishBuilder.com if:-
- If you breach these terms and conditions
- We are not able to verify the information that you have provided to us and therefore have reason to believe that it is not correct
- We have reason to believe that something you have done may be material in instigating a claim against us, cause us financial loss cause damage to the company name.
6. Costs
By joining FindPolishBuilder.com you agree to pay a chosen period non refundable subscription fee which may be varied at any time with 14 days notice being given to the members.
We may at any time and at our sole discretion change some or all of our services. In the event that we introduce a new service(s), the fees for that service are effective at the launch of the service.
Unless otherwise stated, all fees are payable in GBP Sterling. Whether you are a business or not, value added tax and other taxes may apply to your membership or transaction. Members will be responsible for paying all fees associated with using our site and all applicable taxes. You agree that we may, if appropriate, issue you with invoices by email.
7. Rights of Third Parties
A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement.
8. Jurisdiction
These terms and conditions shall be governed and construed in accordance with the Law of England and Wales.
